APEC economies are working to make cross-border commercial disputes simpler and less costly. This is becoming more important as digital trade, electronic contracts, and artificial intelligence change the way businesses operate. Companies need clear rules about which courts can handle a case, which laws apply, and whether a foreign judgment will be recognized. These difficulties can be especially challenging for small and medium enterprises because they often have fewer legal resources.

Legal experts highlighted the need to update international legal instruments. Clearer rules can help businesses protect their assets and resolve disputes more quickly. The Hague Conference on Private International Law also emphasized the importance of legal certainty for economic integration. Businesses need to know how documents, court proceedings, and judgments will work across different countries.

Cross-border cases can take months when documents and evidence must pass through courts, ministries, and embassies. The HCCH Service and Evidence Conventions provide common procedures that can reduce these delays. APEC has also promoted its voluntary Online Dispute Resolution Collaborative Framework. This initiative helps small businesses use online platforms to settle disputes without depending completely on traditional courts.

Digital business creates additional legal challenges. Evidence can be stored in the cloud, contracts can be made electronically, and some disputes may not have a clear physical location. Officials therefore considered measures such as electronic delivery of legal documents and remote court hearings. These changes could make international legal procedures faster and easier to manage as cross-border trade becomes more digital.
